1. Acceptance of Terms
By downloading, installing, or using HabQuest ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Eligibility
You must be at least 13 years of age (or 16 in the European Economic Area) to use HabQuest. By using the App, you represent that you meet this age requirement.
If you are under the age of 18, you represent that you have your parent's or guardian's permission to use the App.
3. User Accounts
3.1 Account Creation
You may create an account using an email address, Google account, or Apple ID. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.2 Guest Access
You may use a limited version of the App without creating an account ("Guest Mode"). Guest sessions are tied to your device and may be lost if you clear app data or reinstall. We recommend creating a full account to preserve your progress.
3.3 Account Responsibility
- Provide accurate and complete information when creating your account
- Keep your account credentials secure and confidential
- Notify us immediately of any unauthorized use of your account
- Use a unique username that does not impersonate others
3.4 Account Termination
You may delete your account at any time via Settings → Delete Account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any regulations
- Attempt to manipulate leaderboard scores, XP, or any gamification data through unauthorized means
- Reverse engineer, decompile, or disassemble the App
- Use automated bots or scripts to interact with the App
- Transmit any harmful, offensive, or disruptive content
- Attempt to gain unauthorized access to our systems or other users' data
- Impersonate other users or create misleading usernames
5. Premium Subscription & In-App Purchases
5.1 Free Tier
HabQuest is available for free with limited features, including advertisements displayed via Google AdMob.
5.2 Premium Subscription
HabQuest offers a premium subscription ("HabQuest Premium") that removes advertisements and unlocks additional features including enhanced rewards, exclusive themes, and premium badges.
5.3 Billing & Payments
- Purchases are processed through the Apple App Store or Google Play Store
- All payments are subject to the terms of the respective platform
- Prices may vary by region and are displayed before purchase
5.4 Refunds
Refund requests for in-app purchases are handled by Apple (App Store) or Google (Play Store) in accordance with their respective refund policies. We do not process refunds directly.
5.5 Changes to Pricing
We reserve the right to change subscription prices. You will be notified of price changes before they take effect, and you may cancel before the new price applies.
6. Leaderboard & Social Features
By participating in the weekly leaderboard, you agree that your username and weekly XP score may be visible to other users of the App. The leaderboard resets every Sunday at midnight UTC.
We reserve the right to remove any user from the leaderboard who is found to be using unauthorized methods to gain XP or manipulate scores.
7. Intellectual Property
The App, including its design, graphics, text, and code, is owned by HabQuest and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.
8. User Content
You retain ownership of any content you create within the App (e.g., habit names, custom settings). By using the App, you grant us a limited license to store and process this content solely for the purpose of providing the App's services to you.
9. Disclaimers & Limitation of Liability
9.1 No Warranty
HabQuest is provided "as is" without warranties of any kind. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
9.2 Health Disclaimer
HabQuest is a productivity and habit-tracking tool for general wellness purposes. It is not a medical device and should not be used as a substitute for professional medical advice, diagnosis, or treatment.
9.3 Limitation of Liability
To the maximum extent permitted by law, HabQuest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or profits, arising from your use of the App.
10. Data & Privacy
Your privacy is important to us. Our collection and use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you also agree to our Privacy Policy.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, through an in-app notification. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction.
